    Acceptance of Terms Through Use (Ver: 3-2021)

    This site provides you the ability to learn about Global IT Communications and its products and services as well as the ability to access our network and services (“Global IT Services”). By using this site, and any other site owned and operated by Global IT, you signify your agreement to the terms, conditions, and notices of this policy. “You”, when used in this statement, shall mean the Global IT Customer of record and Global IT Customer end users.

    This Acceptable Use Policy is used in conjunction with the terms of your service agreement. Violating any of these policies grants Global IT the authority to take action to restrict or terminate your access to Global IT Services. We reserve the right, at our discretion, to update or revise this policy, any other policy or statement on any Global IT website, and any product offerings or programs described on any Global IT website. Please check back periodically to review any changes to this policy.

    Global IT disclaims, to the maximum extent permitted by law, all warranties, representations or other endorsements, express or implied, with regard to the information accessed from, or through, this service, the systems which provide it and the Internet, including all warranties of merchantability or fitness for a particular use, or non-infringement of any third-party rights. Global IT does not assume any liability for the completeness, accuracy, or usefulness of any information disclosed or materials accessed. In no event shall Global IT (or any persons or entities related thereto) be liable for any special, indirect, or consequential damages associated with or arising from the use of this service in any way, including any loss of use, data or profits, regardless of the form of action. Any failure by Global IT to enforce this policy in every instance in which it might have application does not amount to a waiver of Global IT’s rights

    Lawful Use

    You must use this site and the Global IT Services in accordance with the terms of this policy and your Global IT Service Agreement and in accordance with all federal, state, and local laws, ordinances, and regulations.

    User Conduct, Prohibited or Unlawful Use

    In order to maintain an informative and valuable service that meets the needs of the users of this site and Global IT Services, the following rules have been established to protect against abuse.
    Use of this site or Global IT Services for any purpose that is unlawful or in any manner which could damage, disable, overburden or impair the operation of this site, the Global IT Network or Global IT Services, or any other party’s use or enjoyment of this site, the Global IT Network or Global IT Services, is strictly prohibited.

    Specifically, you may not:

    Attempt to use or gain unauthorized access to data, accounts, hosts, servers, systems, or networks of this site, or to probe, scan or test the vulnerability of a system or network of this site, and Global IT Services or those of any other party.

    Interfere with service to any user, host, or network including, without limitation, mail-bombing, flooding, or attempting to overload the system.

    Forge any TCP-IP packet header or any part of the header information in an e-mail or a newsgroup posting.

    Falsify address information or otherwise modify e-mail headers to conceal the sender’s or the recipient’s identity.

    Use this site or Global IT Services to engage in activities that violate any terms or conditions of any other network access provider or Internet service provider.

    Additionally, you may not, by use of any Global IT Service or another service, upload, post, or otherwise distribute or facilitate distribution of any content, including text, communications, software, images, sounds, data, or other information that in Global IT’s discretion:
    Infringes the intellectual property rights of any entity or individual.

    Victimizes harasses, degrades, or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, disability, or any other reason.
    Is posted in violation of a newsgroup charter.

    Contains viruses, corrupted files, or any other similar software or programs that may damage the operation of another’s computer.

    Has a negative effect on Global IT or its network (including, without limitation, overloading servers on the Global IT Network; causing portions of the Global IT Network to be blocked by other network providers; generating unresolved third party complaints or complaints which, in the discretion of Global IT, impose an unreasonable administrative burden on the company; etc).
    Constitutes unsolicited duplicate e-mail (commercial or otherwise).

    This prohibition extends to the sending of unsolicited and/or mass e-mailings from any Global IT account, or via another service which in any way (i) implicates the use of this site or Global IT Services, Global IT equipment, or any Global IT e-mail address; (ii) that is relayed from any Global IT or third party’s mail servers without permission; (iii) which employs techniques to hide or obscure the source of the e-mail; (iv) which are sent or caused to be sent, to or through the Global IT Network that makes use of or contains invalid or forged headers, invalid or non-existent domain names or other means of deceptive addressing may be deemed to be counterfeit.

    Communication may be unsolicited if: (1) recipients’ email addresses were not obtained through a personal or customer relationship between recipient and sender, (2) recipients did not affirmatively consent to receive communications from sender, or (3) recipients have opted out of receiving communications from the sender when given notice of the opportunity to do so.
    Senders should: (i) confirm that the actual owner of each email address, particularly email that is part of a list, agreed to receive email and/or bulk email from the sender; (ii) include their email and/or physical address in any bulk mailings; and (iii) provide recipients with an effective means of removing their email from lists.

    PLEASE NOTE: The transmission of unsolicited bulk email, including the transmission of counterfeit e-mail, may result in civil and criminal penalties against the sender, including those provided by the federal Controlling the Assault of Non-Solicited Pornography and Marketing Act (“CAN-SPAM”) (P.L. 108-187) or Computer Fraud and Abuse Act (18 U.S.C. § 1030 et seq.); the Virginia Computer Crimes Act (Va. Code Ann. § 18.2-152.2 et seq.) (amended effective July 1, 1999); the Washington Commercial Electronic Mail Act ( Wash. Rev. Code Chapter 19.190 et seq.); and any other applicable statutes and regulations.
    Global IT reserves the right to take all legal and technical steps available to prevent unsolicited bulk e-mail or other unauthorized e-mail from being sent from or transmitted through the Global IT Network. Global IT reserves the right, without prior notice, to perform vulnerability tests on systems residing on IP address space belonging to Global IT which may be allocated for Customer use. The purpose of such testing includes but is not limited to, testing of mail servers or proxy servers for unrestricted third party relaying. Global IT will use commercially reasonable efforts to ensure that such testing will not adversely affect the Service provided to the Customer or compromise the security of the Customer’s network. Customers may be required to correct any system vulnerability upon notification and/or suspend or terminate operations of a known compromised system.

    Your participation in online communication or use of any Global IT service is not edited, censored, or otherwise controlled by Global IT. However, Global IT reserves the right to monitor content on this site and any Global IT Services and to remove content, disable sites, or suspend or terminate services if Global IT, in its discretion, determines such content or user practices are harmful, offensive, or otherwise in violation of this Acceptable Use Policy.
    International Use

    Global IT makes no representation that materials available on this site or any or through any Global IT service are appropriate or available for use in locations outside the United States, and accessing them from territories where their contents are illegal is prohibited. Those who access this site or any site hosted by Global IT from other locations are responsible for compliance with local law.

When logged into any IRC server, you must comply with the rules and policies established by that IRC’s service administrator.

    Dial-up Use Rules

    When accessing Global IT Services via dial-up, you must not use Global IT Services to operate server programs, including but not limited to, mail, IRC, FTP, or Web servers. You must not use dial-up access on a standby or inactive basis in order to maintain a connection. The use of automated electronic or mechanical processes to maintain a constant connection, such as the use of an auto-dialer, persistent checking of email, or “pinging” the host, are prohibited.
    Controlling Law and Termination

    This Authorized Use Policy is subject to and shall be construed and enforced in accordance with the laws of the Commonwealth of Virginia without regard to its choice of law principles, and any disputes hereunder shall be brought in the United States District Court for the Eastern District of Virginia.

    Notices

    The Global IT Terms of Service Agreement and Acceptable Use Policy prohibit acts of copyright and trademark infringement and other unlawful behavior by Global IT subscribers. Global IT takes subscriber violations seriously and will investigate complaints and, where appropriate, may remove content, disable sites, suspend or terminate services, or take other action as necessary. Global IT assumes no responsibility for costs incurred for defending or asserting a violation of the Global IT Terms of Service Agreement or Acceptable Use Policy.
    General Complaints: Please send reports of any activity in violation of this Acceptable Use Policy to abuse @ Globalit.com. Global IT will reasonably investigate incidents involving such violations. Global IT may involve and will cooperate with law enforcement officials if any criminal activity is suspected. Violations may result in criminal and civil liability.

    Fraud Complaints: Global IT recognizes that acts of fraud can be and are committed over the Internet. Global IT encourages all Customers and Internet users to be vigilant about protecting their personal information, account numbers, id’s, passwords, etc. As with non-Internet fraud, fraud complaints are best and most appropriately made to law enforcement authorities. If you believe you have been the victim of Internet fraud (either via the web or through email), Global IT encourages you to contact your local or state consumer protection authority, or one among several U.S. agencies that handle complaints about Internet fraud, including Federal Trade Commission (FTC) Complaints about consumer fraud (e.g. related to retail, banking, and other online activity) can be filed with the FTC at https://www.ftc.gov/faq/consumer-protection/submit-consumer-complaint-ftc;

    Global IT Communications, Inc. respects the privacy of every individual. This Privacy Policy applies to Global IT retail Customers and visitors to Global IT websites in the United States. The policy applies to all Global IT Communications companies that collect and/or use Customer information (“Global IT Companies”) as well as all websites owned and operated by Global IT Companies including www.globalit.com, www.Globalit.comwww.gblit.com, www.GlobalITWebDesign.com, www.fastfios.com, www.flext1.com, www.orangeisp.com, and related sites (collectively “the Global IT Sites”). This policy statement provides detailed information about how Global IT collects and uses information gathered about web visitors and Customers. This policy is dated and may change from time to time, so please check back periodically to review this information.

    I. General Principles:

    Personal privacy is important to Global IT. We respect the privacy of every individual and take reasonable measures to protect the privacy of information provided to Global IT by others. The personal information collected by Global IT falls into two basic categories: (1) information collected from and/or provided by website visitors to the Global IT Sites; and (2) information collected about Customers. Third-party service providers or those whose sites may appear on the Global IT Sites may also collect personal information; however, their practices are not necessarily within the control of Global IT.
    Global IT employees are subject to the Global IT Business Ethics Guidelines which include, among other things, compliance with legal requirements and company policies relating to the privacy of communications and the security and privacy of Customer records. Global IT employees are expected to abide by this policy and follow applicable laws, rules, regulations, and court or commission orders that apply to our business. Employees who fail to meet the standards embodied in the Guidelines may be subject to disciplinary action, up to and including dismissal.

    A. Information Collected Via the Internet

    The information available to Global IT when a web visitor is on a Global IT Site helps Global IT to improve the quality and usefulness of our sites. In general, Global IT gathers some generic information automatically to make the Global IT Sites more helpful to visitors. Generic information does not reveal the identity of a visitor and usually consists of the Internet address assigned to the visitor’s computer, the number, and frequency of visitors, the Global IT Sites visited, etc. Global IT accomplishes this by using certain technologies, such as weblog analysis, data-tagging tools, and/or “cookies. ” These technologies can be used to provide the visitor with tailored information about Global IT services and help make our sites more responsive by helping to personalize each visitor’s experience. Global IT does not combine information collected in this way with any personally identifiable information. If you don’t want to accept cookies, you can set your browser to notify you when you receive a cookie and so that it can be refused or accepted. Refusing cookies may, however, make certain features on Global IT Sites unavailable.

    Of course, some activities require personal information — when making a purchase, enrolling for a referral program, using a credit card to pay for services, submitting a resume, requesting certain types of information, sending an email to a Global IT Site, etc. (when provided by web visitors who are or become Customers as a result of their visit to a Global IT Site, such information will thereafter be treated as Customer information, see below). On those sites where visitors voluntarily submit questions, comments, feedback, suggestions, ideas, or the like, Global IT will treat that portion of the information as non-confidential and non-proprietary and assumes no obligation to protect such information from disclosure.

    Whenever personal information is provided on a Global IT Site, it will be used for a specific purpose or to respond to the specific request for which it was given. In most cases, there is the opportunity to select whether Global IT may, or may not, use this information for additional purposes. Individuals may also request that Global IT not use their information for certain purposes by clicking on unsubscribe at the bottom of any correspondence or simply replying to the message with your intent. Global IT continues to have and reserves the right to send Customers service updates, bulletins, and other important information about their Global IT services.

    Absent any instructions limiting the use of a visitor’s information, Global IT may use the contact information provided by visitors to Global IT Sites to provide information about additional services and products offered by the Global IT family of companies, Global IT authorized agents, and other goods and services providers with whom Global IT has relationships and whose offerings might be of interest to visitors. Global IT will not, however, sell or trade a visitor’s personal information unless we are authorized by you or legally required to do so, or in the case of imminent physical harm to the visitor or others.

    Information disclosed in a public space, including on any bulletin board, chat room, or website Global IT hosts for Customers as part of Global IT services is available to anyone else who visits that space. Global IT cannot safeguard any information that is disclosed or stored in these locations. Additionally, Global IT websites contain links to sites that belong to third parties unrelated to Global IT. Global IT assumes no responsibility for the content accessible on such sites or the privacy practices of those content providers and recommends that visitors to those sites review the privacy policy statements of those sites.
    B. Information Collected from Customers

    1. Customer Information Collected by Global IT

    When enrolling for or purchasing services from Global IT, or participating in a business referral program, Customers may be required to provide some or all of the following information in order to establish an account and order services: Name; Service Delivery Location/Address; Billing Address; Account Number; Credit card number; Phone or Fax Number; and Email Address. For account security, verification, or tax purposes, Global IT may also request the Date of birth, Social Security Number, or Driver’s license number of the person placing the order or making a service request. For corporate accounts, Global IT may also request the Company/Customer name, Federal Tax ID, and other information a company Customer/employer may ask Global IT to collect, such as purchase order number, employee number, and job title of the individual responsible for business account administration.

    2. How Global IT Uses Customer Information

    Global IT needs the Customer information it collects from telephony and data Customers to process orders, provide, and bill for services. Global IT may also share necessary information with outside parties, such as third-party vendors or shipping companies, to complete an order.
    In the normal course of providing local and long-distance telephone services, Global IT collects and maintains this information which, when matched with detailed Customer call activity, calling patterns, class or type of service, technical characteristics, long-distance and local service billing records, directory assistance charges, and other information is known under Federal Communication Commission (“FCC”) regulations as Customer Proprietary Network Information (“CPNI”).

    Absent any restrictions on our use of CPNI or instructions from you otherwise, Global IT may use Customer information and/or CPNI to provide information about additional services and products offered by the Global IT family of companies, Global IT authorized agents, and other goods and services providers with whom Global IT has relationships and whose offerings might be of interest to Customers. Global IT will not, however, sell or trade CPNI or other contact information unless we are authorized by a Customer or legally required to do so. You may update your contact information and/or request that Global IT refrain from using your CPNI or other contact information for commercial purposes by contacting your Customer Care representative at 877-822-5565. Restricting the use of CPNI or opting out of receiving commercial communications from Global IT will not eliminate all Global IT marketing or other contacts about the Services provided to a Customer. Additionally, Global IT and its agents can and will use Customer contact information to get in touch with Customers if Global IT has trouble processing an order or needs to contact a Customer about a service or billing-related matter. Global IT may also, where permitted by law or authorized by a Customer, provide this information to credit bureaus, or provide information and/or sell receivables to collection agencies, to obtain payment for Global IT-offered products and services.

    3. Directory Information and Caller ID

    Customers that subscribe to Global IT local telephone service are given the opportunity to request that their name, number, and address be or not be published in directories, be made available through directory assistance, or appear in “Yellow Pages” or other similar business directories. Such requests may require payment of additional fees. Please contact your local Global IT service representative for more information. Telephone service Customer’s name and number may be, where available, transmitted, and displayed on a Caller ID device unless the caller has elected to block such information. Please note that Caller ID Blocking does not prevent the display of your number when dialing certain business numbers, 911, 900 numbers, or toll-free 800, 888, 877.

    II. Email Addresses

    Global IT collects email address information from Internet visitors and Customers (where voluntarily provided or required). Global IT will use your email address to respond to any email inquiry sent to Global IT or to follow up on your visit to the Global IT Sites. From time to time, Global IT may send emails about Global IT products and services, or offers that Global IT believes will be of interest. Global IT may also share your email address with providers with whom Global IT has a relationship and who either provide Global IT-offered services or whose products or services may also be of interest. In all cases, we hope recipients will find this information useful, but if you do not wish to receive such email from Global IT, please indicate that you’d prefer not to receive such information or offers from Global IT when you provide your email address. You can always change your preferences by clicking on the “unsubscribe” link that we include in all of the commercial emails we send.

    III. Exceptions and Limitations

    There are times when, in order to comply with applicable laws, regulations, court or administrative orders, subpoenas, or other matters, Global IT must disclose information. Global IT cooperates fully with state, local, and federal officials in any investigation relating to any content (including personal or private electronic communications transmitted to Global IT) or purported unlawful activities of any user of any Global IT Site or Global IT service, and takes reasonable measures to protect the proprietary rights of the Global IT Companies. If necessary to comply with law or cooperate with law enforcement activity, Global IT may disclose personally identifiable information of web visitors and/or Customers. Global IT reserves the right to, and will, share information when it believes, in its sole discretion, it is necessary to prevent unlawful use of communications services, when necessary to repair or restore network outages, in emergency situations (e.g. 911 calls; matters of public safety, etc) or to protect the security or integrity of the Global IT Sites or the Global IT Companies. In addition, Global IT may monitor the areas of communication of any kind (i) to satisfy any law, regulation, or a government request (e.g. response to private or law enforcement-issued subpoena); (ii) if such disclosure is necessary or appropriate to operate Global IT (e.g. recording of Customer Care calls); or (iii) to protect the rights or property of Global IT or others (e.g. to prevent fraud, infringement of rights, etc).
    IV. Security

    Global IT utilizes technological and business efforts to keep Customers’ personal information secure and confidential through safeguards such as the use of secure encryption technology during transmission of certain data, or by restricting physical access to systems on which personal information is stored by appropriate logon and/or password controls. Information collected from visitors and customers is stored in databases Global IT controls directly or through contracts with service providers. Credit card information is used only to bill Customers for the products and services they receive. Global IT does not share credit card information except as may be necessary to process Customer transactions. On those Global IT Sites where you may provide Global IT with credit card or other ordering information via the web, Global IT employs customary web-based security and encryption protocols, examples of which include Secure Socket Layer (SSL) and Secure Electronic Transaction (SET), to secure transmission of that information. If your browser does not support the use of such secure connections, or if you prefer not to send your credit card number over the Internet, you can place your order by calling us at the toll-free number listed at https://globalit.com/contactus/ (US only). However, as effective as modern security practices are, no physical or electronic security system is impenetrable. Global IT cannot guarantee the security of databases, nor can Global IT guarantee that information supplied by you will not be intercepted while being transmitted over the Internet.

    V. IP Address Policy to the Terms and Conditions

    Internet Protocol (IP) addresses allocated to customers of Global IT Communications, Inc or any division, subsidiary of Global IT is the property of ARIN (American Registry of Internet Numbers) and its successors (“ARIN”) and are allocated by Global IT pursuant to rules and guidelines promulgated by ARIN (as established under the authority of the Internet Assigned Number Authority) and the policies of Global IT, for no longer than the duration of the customer’s service agreement with Global IT (“IP Addresses”). Global IT’ customer (“Customer”) acknowledges that the IP Addresses made available to it are the property of ARIN and as such the Customer acknowledges it has no rights of ownership of the IP Addresses.

    IP Addresses allocated by Global IT are available to any Enterprise Internet Customer of Global IT who is eligible for an IP address allocation from Global IT. Any Customer who is eligible for its own assignment of IP addresses from ARIN is responsible for making its own application for such assignment and shall not be eligible for an IP address allocation from Global IT. Any Customer who has been allocated IP Addresses by Global IT and who subsequently becomes eligible for its own assignment of IP addresses from ARIN must make an application to ARIN for assignment of its own IP addresses.

    Any Customer making use of IP Addresses allocated to it by Global IT and who subsequently receives its own assignment of IP addresses of an equivalent or larger allotment from ARIN or in any other manner, must release all of the IP Addresses allocated to it by Global IT and renumber from its subsequently acquired IP addresses according to the following schedule:
    1. Return a minimum of 1/3rd (33%) of its IP Addresses to Global IT within 3 months of receiving its assignment of IP addresses from ARIN;

    2. Return 2/3rd(66%) of the remaining IP Addresses to Global IT within 6 months of receiving its assignment of IP addresses from ARIN; and

    3. Return 100% of all IP Addresses to Global IT within 9 months of receiving its assignment of IP addresses from ARIN.

    Where the Customer’s assignment from ARIN is less than its Global IT IP Address allotment, the Customer must release and renumber as set out above, but only up to the number of IP Addresses received from ARIN.

    Notwithstanding the above, in the event the Customer is in breach of any agreement with Global IT and the Customer’s service has been suspended, any IP Addresses allocated to it by Global IT will be invalidated in conjunction with such suspension until such breach has been remedied to the satisfaction of Global IT and the Customer’s service has been restored.
    Global IT cannot guarantee that identical IP Addresses will be reallocated to the Customer in such circumstances.

    In the event the Customer and Global IT agree to a temporary allocation of IP Addresses, such IP Addresses will be invalidated by Global IT upon the agreed termination date and without any further notification to the Customer. It is the Customer’s sole responsibility to prepare for such invalidation. No extensions or continuances will be made.

    Customers will be required to maintain accurate and up-to-date IN-ADDR (reverse DNS) records detailing the usage of their IP Addresses. Global IT reserves the right to invalidate any allocation of IP Addresses once it determines there are no IN-ADDR records for such IP Addresses.

    Customers who reallocate IP Addresses to their own downstream clients remain responsible for the terms and conditions set out herein, including but not limited to ensuring that such downstream clients maintain accurate IN-ADDR records and that Global IT be able to access such records at its reasonable convenience.

    In addition to the above, IP Addresses are allocated by Global IT on the basis of the Customer’s immediate utilization rates and as per www.arin.net rules for IP utilization. Global IT reserves the right to invalidate the allocation of IP Addresses that are not utilized by the Customer within the first three (3) months of such allocation. Global IT also reserves the right to reduce the IP Addresses allocated to a Customer if such allocation is underutilized or ineffectively used by the Customer or the Customer’s use is not in compliance with www.arin.net rules.

    All allocations of IP Addresses are subject to audit and verification by any reasonable means deemed appropriate by Global IT. If any allocation of IP Addresses is found to have been based on false information, Global IT may invalidate the allocation.
    An agreement of service between the Customer and Global IT does not ensure allocation of any specific allotment of IP Addresses by Global IT to the Customer.

    Where an existing Global IT Customer purchases the shares or assets of another entity, or otherwise merge or creates a joint relationship with such other entity, it will be in Global IT’ sole discretion, with regard to utilization, need, and the other factors discussed in this Policy, whether to invalidate any IP Addresses and how many such IP Addresses are to be invalidated.

    VI. Protecting the Privacy of Children

    Protecting the privacy of the very young is uniquely important, particularly on the Internet. Global IT Sites are designed to provide commercial business information and allow service ordering and management by adults. Global IT Sites are not designed to attract minors, in particular children under the age of 13. Global IT does not market to or knowingly collect information from anyone under the age of 13. Children should always get permission from their parents before sending any information about themselves (such as their names, email addresses, and phone numbers) to anyone over the Internet.
